Sales Agreement

1. Parties

This Sales Agreement (the "Agreement") is concluded between: TECHNOTOWN SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (KRS: 0001183364, NIP: 5273173009, REGON: 54222356500000, Address: Aleja Solidarności 88/66, 01-003 Warszawa, Poland) (hereinafter referred to as "Operator" or "Seller"); and natural and legal persons who purchase paid services offered through polskajob.com (the "Platform") (hereinafter referred to as "Buyer" or "you").

By purchasing a paid service through the Platform, the Buyer declares and undertakes that they have read, understood, and accepted the entirety of this Agreement.

2. Subject of the Agreement

The subject of this Agreement is to determine the rights and obligations of the parties regarding the sale of membership packages, job posting rights, or other paid Platform services ("Services") purchased by the Buyer through the Platform.

3. Services, Prices, and Payment Terms

3.1. The Services offered for sale, their features, and prices are clearly specified in the relevant sections of the Platform. The Seller reserves the right to change the features and prices of these Services at any time. Changes become effective upon their publication on the Platform. 3.2. The Buyer selects the Service they wish to purchase through the Platform. The current price of the selected Service and the total cost including VAT (Value Added Tax), if any, will be displayed to the Buyer before the payment transaction. 3.3. Payments are made through the online payment methods specified on the Platform (credit card, bank transfer, etc.). Payment transactions are carried out by secure third-party payment providers. The Buyer is responsible for the accuracy of payment information. 3.4. Once payment confirmation is received, the activation process of the purchased Service begins as specified on the Platform. 3.5. In return for payments made, the Seller issues an invoice in accordance with Polish law and delivers it to the Buyer electronically or physically upon request.

4. Cancellation and Refund Conditions

4.1. Due to the nature of the purchased Services, being digital and based on immediate use, they may be excluded from the right of withdrawal. The Buyer declares that they accept this condition before purchasing the Service. 4.2. General Rule: Unless explicitly stated otherwise on the Platform or legally required, no cancellation or refund will be made for purchased membership packages, job posting rights, or other paid Services. 4.3. Exceptional Circumstances: In situations where the Service cannot be provided due to a technical fault originating from the Seller or if it does not possess the promised qualities, the Seller may, at its discretion, provide a partial refund to the Buyer or re-provide the Service. In such cases, the Buyer must report their complaint in writing to info@technotown.pl. 4.4. In the event that membership is terminated by the Seller due to a breach of the Membership Agreement, paid fees are non-refundable.

5. Seller's Rights and Obligations

5.1. The Seller undertakes to provide the Services to the Buyer in accordance with the features and standards specified on the Platform. 5.2. The Seller takes necessary technical and administrative measures to ensure the security of payment transactions. 5.3. The Seller endeavors to ensure the uninterrupted and error-free operation of the Platform but is not responsible for interruptions caused by technical failures, maintenance work, or force majeure events.

6. Buyer's Rights and Obligations

6.1. The Buyer undertakes to make payments for the purchased Services fully and on time. 6.2. The Buyer is obliged to provide accurate and up-to-date payment information. The Buyer is responsible for any consequences arising from the provision of incorrect or incomplete information. 6.3. The Buyer shall use the purchased Services in accordance with the Membership Agreement and applicable laws. Misuse of the Services or their use for illegal purposes is prohibited.

7. Intellectual Property Rights

All intellectual property rights (copyright, trademark rights, etc.) of the Platform and the Services offered belong to the Seller. The Buyer may not take any action that infringes these rights.

8. Disclaimer and Limitation of Liability

8.1. The Seller does not guarantee that the purchased Services will fully meet the Buyer's specific expectations. Services are provided "as is." 8.2. The Seller is not responsible for the outcomes of recruitment processes or commercial interactions conducted through the Platform. The Platform is merely an intermediary that brings parties together. 8.3. The Seller's total liability under this Agreement is limited to the price paid by the Buyer for the purchased Service. The Seller cannot be held responsible for indirect damages or loss of profit.

9. Force Majeure

In the event of disruptions in the provision of Services due to circumstances beyond the Seller's control, such as natural disasters, war, acts of terrorism, riots, embargoes, government decisions, internet outages, infrastructure failures, the Seller cannot be held responsible for these situations.

10. Governing Law and Jurisdiction

The laws of the Republic of Poland shall govern the interpretation and application of this Agreement. The Courts and Enforcement Offices of Warsaw (Warszawa) shall have jurisdiction over any disputes arising from this Agreement.

11. Other Provisions

11.1. If any provision of this Agreement is deemed invalid or unenforceable, it will not affect the validity and enforceability of the remaining provisions. 11.2. The Seller's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
