Membership Agreement

1. Parties

This Membership Agreement (the "Agreement") is entered into between: TECHNOTOWN SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (KRS: 0001183364, NIP: 5273173009, REGON: 54222356500000, Address: Aleja Solidarności 88/66, 01-003 Warszawa, Poland) (hereinafter referred to as "Operator" or "we"); and natural and legal persons who register for membership to benefit from the services offered through polskajob.com (the "Platform") (hereinafter referred to as "Member" or "you"). This Agreement is concluded to regulate all transactions carried out by the Member on the Platform.

By becoming a member of the Platform, you declare and undertake that you have read, understood, and accepted the entirety of this Agreement.

2. Definitions

• Platform: The internet website and/or mobile applications operated by the Operator and accessible via the polskajob.com domain.
• Member: A natural or legal person, either a job seeker or an employer, who registers as a member on the Platform and benefits from Platform services under the terms of this Agreement.
• Job Seeker: A Member who views job postings, uploads CVs, applies for jobs, or makes their profile visible to other users through the Platform.
• Employer: A Member who posts job advertisements, views candidate profiles, or communicates with candidates through the Platform.
• Content: Any information, data, text, graphics, visuals, audio, or video material uploaded by Members or published through the Platform.
• Services: All facilities offered by the Operator through the Platform, such as job searching, job posting, profile creation, communication, and similar functionalities.

3. Membership and Registration Conditions

3.1. To become a member of the Platform, you must be of legal age (18 years or older) and not have been temporarily suspended or permanently banned from membership by the Operator. Legal entities may become members through their legal representatives. 3.2. During the membership registration process, Members are obliged to provide accurate, complete, and up-to-date information. In case of providing false or misleading information, the Operator reserves the right to suspend or terminate the membership. 3.3. The Member is solely responsible for the security of their username and password. The Member accepts full responsibility for any consequences arising from sharing these credentials with third parties. 3.4. Membership requires the purchase of a subscription or usage right valid on the Platform. In this case, the relevant pricing and conditions will be specified separately on the Platform.

4. Membership Fees and Payment

4.1. Access to certain services on the Platform (e.g., publishing job advertisements, benefiting from premium membership advantages, accessing CVs, etc.) may be subject to membership fees. Membership fees are collected based on the tariff clearly stated on the Platform. 4.2. The Member is deemed to have accepted the current fees and payment conditions before starting to use paid services. 4.3. Payments are made through the online payment methods specified on the Platform. The Operator takes necessary measures to ensure the security of payment transactions but is not directly responsible for any issues that may arise from transactions processed via third-party payment providers. 4.4. Membership fees are non-refundable unless otherwise specified. In the event that the Member cancels their membership or their membership is terminated by the Operator due to a breach of this Agreement, paid fees will not be refunded.

5. Member's Rights and Obligations

5.1. Platform Usage: The Member agrees and undertakes to use the Platform in accordance with laws, moral rules, and the provisions of this Agreement. 5.2. Content Upload: The Member declares that all Content (CV, job advertisement, profile information, etc.) uploaded to the Platform is accurate, up-to-date, and does not infringe upon the intellectual property rights or personal rights of third parties. 5.3. Data Visibility: CVs and profile information uploaded by Job Seeker Members may be viewed by Employer Members; job advertisements and company information published by Employer Members may be viewed by Job Seeker Members. As the primary purpose of the Platform is to bring parties together, the Member acknowledges and declares that this data will be visible to other Members and that this situation will affect privacy expectations. For detailed information, please review our Privacy Policy. 5.4. Prohibition of False Information: The Member shall not publish misleading, false, incomplete, or deceptive information on the Platform. 5.5. Prohibition of Harassment and Annoyance: The Member shall not engage in any conduct that is harassing, annoying, offensive, hateful, or illegal towards other Members or third parties. 5.6. Disclaimer: The Member accepts that the Operator is not responsible for the actions or listings of other Members with whom they communicate or transact through the Platform. All interactions are the Member's sole responsibility. 5.7. No Job/Employee Placement Guarantee: The Operator explicitly states that the Platform is merely an intermediary and does not guarantee job placement for the Member or employee placement for an employer. The Operator is not responsible for the outcomes of job interviews, recruitment processes, or employment relationships conducted through the Platform. The Platform operates on a "C2C" (consumer-to-consumer) like model, connecting parties and leaving the management of processes to the Members.

6. Operator's Rights and Obligations

6.1. Service Provision: The Operator provides the necessary technical infrastructure to ensure the uninterrupted and error-free operation of the Platform. However, it is not responsible for interruptions caused by technical failures, maintenance work, or force majeure events. 6.2. Content Review: The Operator reserves the right to review Content uploaded to the Platform and to remove or modify Content that violates this Agreement or applicable laws. However, it is not obligated to review all Content. 6.3. Membership Termination: The Operator reserves the right to unilaterally suspend or terminate membership without notice if the Member violates the provisions of this Agreement, engages in illegal activities, or jeopardizes the security of the Platform. 6.4. Agreement Changes: The Operator reserves the right to unilaterally amend this Agreement. Changes made shall take effect on the date they are published on the Platform. The Member is obliged to regularly check the Agreement to be informed of any changes.

7. Intellectual Property Rights

7.1. The design, software, visuals, texts, and all intellectual property rights of the Platform belong to the Operator. These may not be copied, distributed, or used without the Operator's written consent. 7.2. The Member declares that they own the intellectual property rights to the Content (CV, job advertisement, etc.) uploaded to the Platform or have the authority to publish such Content on the Platform. The Member grants the Operator a limited, royalty-free, worldwide license to use, reproduce, and distribute this Content for the purpose of promoting the Platform and providing services.

8. Disclaimer and Limitation of Liability

8.1. The Operator does not guarantee that the Platform will be continuously accessible, error-free, or free of viruses. The Operator is not responsible for any direct or indirect damages arising from the use or inability to use the Platform. 8.2. The Operator accepts no responsibility for the accuracy, currency, or completeness of Content provided by other Members on the Platform. 8.3. The Operator is not a party to any disputes, damages, or commercial relationships that occur between Members and cannot be held responsible for damages arising from such disputes. 8.4. The Operator's total liability to the Member under this Agreement, for whatever reason, shall not exceed the total membership fees paid by the Member to the Operator.

9. Termination of Agreement

9.1. The Member may terminate their membership at any time through the settings section on the Platform or by providing written notice to the Operator. 9.2. The Operator has the right to immediately terminate the membership, with or without notice, if the Member violates the provisions of this Agreement. 9.3. In case of membership termination, all rights and privileges of the Member cease. Paid membership fees are not refundable.

10. Governing Law and Jurisdiction

The laws of the Republic of Poland shall govern the interpretation and application of this Agreement. The Courts and Enforcement Offices of Warsaw (Warszawa) shall have jurisdiction over any disputes arising from this Agreement.

11. Other Provisions

11.1. If any provision of this Agreement is deemed invalid or unenforceable, it will not affect the validity and enforceability of the remaining provisions. 11.2. The Operator's failure to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision.
